Claim against TÜV Rheinland, PIP’s notified body responsible for certifying its pre-filled silicone breast implants.
Le Tutour Avocats acts in France on behalf of 1,300 English and Australian claimants who received defective PIP IMGHC breast implants, in proceedings against TÜV Rheinland (both its German and French subsidiaries) for failures in the certification of the implants.
Between 1997 and 2010, the French company PIP, based in La Seyne-sur-Mer, manufactured and marketed breast implants pre-filled with a non-compliant, hydrocarbon-based gel. This resulted in an abnormally high rupture rate of the implant shell and the subsequent leakage and dissemination of the gel within patients’ bodies.
TÜV Rheinland certified these implants for a period of thirteen years and failed to detect any irregularities in the manufacturing process that enabled the free circulation of these products on the market. On the contrary, the notified body even commended the manufacturer for its production processes.
Several French court decisions have since been issued against the notified body.
Approximately 400,000 women worldwide have been implanted with PIP breast implants.
