PIP breast implant scandal: Le Tutour Avocats is leading a joint action against TÜV Rheinland, the certifying body for PIP breast implants, on behalf of 1,200 women

Le Tutour Avocats is currently representing the interests of 1,200 English and Australian plaintiffs who have defective PIP breast implants before the Versailles Court of Appeal.

In a ruling by the Nanterre Court of Justice, the German notified body TÜV Rheinland and its sister company TÜV Rheinland France were jointly ordered to compensate the eligible claimants in the amount of approximately €10,000 to €37,500 each.

For years, PIP marketed breast implants pre-filled with a non-compliant and adulterated gel, resulting in an abnormally high rate of shell rupture and the subsequent spread of untested gel into the bodies of the recipients.

The German company TÜV Rheinland and its sister company, which was not authorised to do so, certified these implants for 13 years. The Nanterre Court of Justice found numerous serious breaches of their obligations, resulting in their joint and several liability.

The notified body TÜV Rheinland has already been convicted by several French courts:

In its ruling of 25 May 2023, the Court of Cassation confirmed the joint and several liability of TÜV Rheinland Germany and TÜV Rheinland France, that the German certifier had failed in its obligations of vigilance and prudence, and that its French sister company had committed faults that engaged its liability, jointly and severally with that of TÜV Germany.

It referred several aspects of the case back to the Lyon Court of Appeal for retrial in light of the legal principles established.

The number of women worldwide with PIP implants is estimated at 400,000.
